These Terms of Service ("Terms") govern your access to and use of the NauticBoss platform and website (the "Service") provided by Pond Consulting ("we," "us," or "our"). By registering for or using the Service, you agree to be bound by these Terms.
1. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Free Trial
New accounts receive a 15-day free trial. At the end of the trial period, your selected pricing tier will apply unless you cancel before the trial ends. We reserve the right to modify or discontinue the free trial offer at any time.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload malicious code or content that violates third-party rights
- Share account credentials with unauthorized parties
4. Your Data
You retain ownership of all data you submit to the Service. You grant us a limited license to process your data solely to provide and improve the Service. We handle your data in accordance with our Privacy Policy.
5. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
6. Fees and Payment
Paid plans are billed monthly according to the pricing tier selected at registration. Fees are non-refundable except as required by applicable law. We may change pricing with 30 days' notice to existing subscribers.
7. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by Pond Consulting and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, Pond Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
Either party may terminate the account at any time. We may suspend or terminate access if you violate these Terms. Upon termination, your right to use the Service ceases, and we may delete your data after a reasonable retention period.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
